Privacy Policy

This Privacy Policy describes how JK Creative LLC ("JK Creative," "we," "us," or "our") collects, uses, and protects information in connection with the purchase and delivery of Curato, our AI-powered recommendation engine for premium cigar retail. We are committed to handling the limited data we do collect with transparency and care.

The short version: We collect your name and email address to process and deliver your order. Payments are handled entirely by Square. The Curato software itself, once delivered, runs on your own infrastructure and collects no personal information on our behalf.

1. Who This Policy Covers

This policy applies to individuals who visit the Curato storefront at curato.jkcreative.store and to buyers who purchase and receive a Curato license. It does not govern what end users of a buyer's deployed Curato installation experience; that is governed by the buyer's own privacy practices.

2. Data We Collect at Purchase

When you purchase Curato, the following information is collected:

We do not collect IP addresses, device fingerprints, browser data, or behavioral analytics on the storefront. We do not use cookies, tracking pixels, or any third-party analytics scripts.

3. Payment Processing by Square

All payment transactions are processed by Square, Inc. ("Square"). JK Creative does not receive, store, or have access to your payment card number, CVV, or full billing address. Square is a PCI DSS-compliant payment processor.

When you complete a purchase, Square transmits to JK Creative only the information needed to fulfill your order: your name, email, the product purchased, the amount paid, and an order reference number.

Square's collection and handling of your payment information is governed by Square's Privacy Policy, available at squareup.com/legal/privacy. We encourage you to review it before completing a purchase.

4. How We Use Your Information

We use the information described in Section 2 for the following purposes and no others:

We do not use your information for marketing purposes, targeted advertising, profiling, or any automated decision-making. We do not send promotional emails.

5. The Curato Software Collects No PII

Once delivered, the Curato software runs entirely on your own servers and infrastructure. JK Creative has no connection to, access to, or visibility into your deployed installation.

Curato processes product catalog data (cigar names, descriptions, flavor profiles, pricing) to generate recommendations. It does not collect, transmit, or store personally identifiable information about your end users. No data from your installation is sent to JK Creative systems.

You are solely responsible for the data practices of your own deployed installation and for complying with privacy laws applicable to your business and your customers.

6. No Third-Party Data Sharing

We do not sell, rent, trade, or share your personal information with any third party for their own purposes. The only parties who receive any of your information are:

We may disclose your information if required to do so by law, regulation, legal process, or enforceable governmental request, or to protect the rights, property, or safety of JK Creative, our customers, or others.

7. Data Retention

We retain purchase records (name, email, order details) for two (2) years from the date of purchase. This retention period supports tax compliance, accounting obligations, and license support. After this period, records are deleted or anonymized.

If you request deletion of your information (see Section 9), we will honor that request subject to any legal obligation to retain records for tax or legal purposes.

8. Data Security

We implement reasonable administrative and technical safeguards to protect the limited personal information we hold. Access to purchase records is restricted to authorized personnel only.

No method of transmission over the internet or electronic storage is 100% secure. While we take reasonable precautions, we cannot guarantee absolute security.

9. Your Privacy Rights (CCPA / California Residents)

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants you the following rights with respect to your personal information:

Right to Know

You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you, the categories of sources from which it was collected, the purposes for which we collected it, and the categories of third parties with whom it was shared.

Right to Delete

You have the right to request deletion of your personal information, subject to certain exceptions (such as legal retention obligations).

Right to Opt Out of Sale or Sharing

You have the right to opt out of the sale or sharing of your personal information. JK Creative does not sell or share personal information for cross-context behavioral advertising. No opt-out action is required.

Right to Non-Discrimination

We will not discriminate against you for exercising your CCPA rights.

To exercise your rights, submit a request to support@jkcreative.store with the subject line "Privacy Request." We will respond within 45 days. We may need to verify your identity before processing your request.

10. Washington State Privacy and Breach Notification

JK Creative LLC is organized and operates under the laws of Washington State. Washington's data breach notification law (RCW 19.255.010) requires us to notify affected individuals in the event of a security breach involving personal information.

In the event of a breach affecting your personal information, we will notify you within 30 days of discovery by email to the address associated with your purchase, and will notify the Washington State Attorney General as required by law.

11. CAN-SPAM Compliance

JK Creative sends transactional emails only (order confirmations, download links, support responses). We do not send commercial or promotional email without your explicit consent.

12. Children's Privacy

Curato is a B2B software product sold to businesses. We do not knowingly collect personal information from individuals under the age of 18. The product is not directed at or intended for use by minors. If you believe a minor has submitted information to us, contact us immediately and we will delete it.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. The policy in effect at the time of your purchase governs that transaction. We encourage you to review this page periodically.

We will not materially reduce your privacy rights under this policy without providing reasonable notice.
